What is the importance of granting a Power of Attorney?

It enables you to give to the person you choose, authority to make decisions or take necessary actions on your behalf at times when you are not able to do this. There could be many reasons; you become unwell and have to go to hospital and therefore would be unable to manage your day to day finances, or maybe you become incapable of making decisions and therefore you would need someone to be there and look after your interests. These decisions could be related with your property that would need looking after or even selling in order to ensure that you could be looked after financially should you need to go into a care home. It is most important to have Power of Attorney between husband and wife or in the case of an unmarried couple from one partner to another, this way you are covered in all aspects.

What kind of Power of Attorney should I consider?

You can choose a trusted close friend or family member or if you don’t have anybody in the country you can use a Solicitor or if you wish and maybe feel happier you could combine both and grant a joint one, whoever you choose will be your Attorney and the type of Power can be for a specific reason, like selling your property and dealing with the financial side of things only, or a general one to cover all events and especially if your mental capacity was to fail.

Where do I go to obtain a Power of Attorney?

As solicitors, we can help you decide what is best to do and normally suggest that you appoint at least two Attorneys or a substitute Attorney in order to be protected if anything should happen to one of them.

Once we have taken the instructions the Power of Attorney will be signed in the presence of a Spanish Notary who will ensure that you are capable of granting the Power and that the instructions are really your wishes.

What happens if I wish to cancel the Power of Attorney?

This is an easy process and can be revoked whenever you wish, but bear in mind in order for it to take immediate effect it will have to be cancelled in the presence of a Spanish Notary but not necessarily the same one that issued it.
